 2. General

These general conditions of sale represent all the stipulations which constitute the offer issued by [email protected] to any potential purchaser of its products.

The purchaser will be designated in the text below by the Client.

Placing an order implies the Customer's full acceptance of these general conditions of sale.

Any contrary condition posed by the Customer is unenforceable against [email protected].

[email protected] cannot be contractually bound by any other document than these general conditions of sale and in particular prospectuses or catalogues, which have only an indicative value.

[email protected] reserves the right to modify these general conditions at any time.

 3. Order

3.1.The Customer confirms his order by clicking on the "validate" button. After having checked the content of the order in his "Basket" and, if necessary, having modified it, the Customer validates it definitively by payment by clicking on the "pay" button, then "validate".

3.2. Payment for orders is made by bank card (BLUE, VISA, EUROCARD MASTERCARD) indicating the 16 digits of your card, the expiration date (MONTH + YEAR) as well as the cryptogram number (3-digit number on the back of credit card) via the secure Paypal website. Payment is made online on a secure server.

3.3. The order is not final until payment of the corresponding price.

3.4. [email protected] will systematically confirm each Customer's order, then send it by email to the address indicated on your [email protected] account.

 4. Price

4.1. The prices mentioned are in £ sterling, presented inclusive of VAT (20%) and do not include participation in the shipping costs which are borne by the customer. Certain products mentioned benefit from FREE delivery costs.

4.2. Prices are subject to change at any time.

 5. Shipping costs

All orders give rise to invoicing for a contribution to the shipping costs, except for the products mentioned for free delivery.

The shipping costs include the participation in the costs of processing the order (receipt of the order, packaging of the products ordered) as well as the participation in the delivery costs.

Shipping costs are calculated according to the weight of the product and the distance.

The amount of shipping costs is indicated in the order basket, in the summary of the order and on the invoice.

 6. Delivery

6.1. The products will be sent to the delivery address that the Customer has indicated during the order process. 

6.2. In the event of delay in delivery, the Customer can contact the customer service of [email protected] whose UK contact details are given above.

The Customer will be reimbursed within 30 days of their cancellation request.

6.5. Delivery is deemed to have been made as soon as the product is made available to the Customer, this being materialised by the control system used by the transporter.

6.6. The Customer undertakes, after opening and checking the content of the package or packages in the presence of the carrier, to sign the delivery receipt.

In the event of failure to deliver (broken or damaged parcel, missing or damaged products), it is the Customer's responsibility to formulate any reservation in a precise manner on the delivery receipt of the transporter, to confirm them to the transporter by registered letter with acknowledgment of receipt. within three working days of receiving the products and, at the same time, informing customer service; otherwise, [email protected] may in no case be held liable and therefore, no claim for compensation will be granted.

In the event of transport damage, the Customer must refuse the damaged product to the carrier and indicate "Refusal for damage" on the carrier's delivery receipt; otherwise, any recourse against the latter would be impossible.

Do not hesitate to contact us if you need further information. 

 7. Availability of the product

If the product was partially or completely unavailable after placing the order, the Customer would be informed, by email, of the delivery of a partial order or the cancellation of his order.

In application of article L121–20–13 of the consumer code, in case of unavailability of the product the Customer then has the option:

either to be delivered with a product of equivalent quality and price, while stocks last;

either to be reimbursed for the price of the product ordered within 30 days of its request.

In this case, the delivery costs of a new product will be borne by [email protected]

8. Cancellation period

8.1. The Customer has a right of withdrawal which he can exercise within fourteen clear days from the day of delivery of his order, the date appearing on the transport slip being taken.

When the period of fourteen days expires on a Saturday, a Sunday or a public or non-working day, it is extended until the next working day.

8.2. If the Customer uses this right of withdrawal, the products must be returned in their original packaging, in perfect condition for resale, unused and accompanied by all accessories and any notices as well as the duly completed return slip.

Only the price of the product (s) purchased and the shipping costs will be reimbursed to the Customer. Return costs remain the responsibility of the Customer.

The reimbursement will be made within 30 days of receipt of the returned products.

8.3. For the exercise of the right of withdrawal, the Customer must, before returning the products, contact the Customer Service by telephone who will indicate the procedure to follow.

8.3. To give rise to a credit or a refund, the returned products must be in perfect condition for resale and complete, including the packaging.

8.4. Sale between professionals: no withdrawal period can be exercised in the case of a sale of products between professionals, except in the case where the customer is not a professional in the sector, and where this can be assimilated to a non-professional consumer.

9. Contractual guarantee

9.1. The customer benefits from a contractual guarantee on the products supplied by [email protected].

9.2. The responsibility of the manufacturer is not engaged and the guarantee is not applicable in the case of defective installation, ill-adapted, not in conformity with the standards in force, or with the rules of the art, as well as in the case of abnormal use, lack of maintenance or unsuitable maintenance, or if the damage has been caused by chemicals or lime. The warranty is not valid if the Customer modifies or has the elements or part of the device modified, compared to the original supply.

10. Legal guarantees

10.1. Guarantee for non-conformity

In accordance with articles L 211–4 et seq. Of the Consumer Code, as well as articles 1641 and 1648 of the Civil Code, the Customer benefits from a guarantee allowing him to return the products delivered defective.

Article L211–4 of the Consumer Code

The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.

It is also responsible for any lack of conformity resulting from the packaging, the assembly instructions or the installation when this has been borne by the contract or has been carried out under its responsibility.

Article L211–5 of the Consumer Code

To be in conformity with the contract, the good must:

1. Be suitable for the use usually expected of a similar good and, if necessary:

- correspond to the description given by the seller and have the qualities that the latter has presented to the buyer in the form of a sample or model;

- present the qualities that a buyer can legitimately expect in view of the public statements made by the seller, by the producer or by his representative, in particular in advertising or labelling;

2. Or have the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the knowledge of the seller and which the latter has accepted.

Article L211–12 of the Consumer Code

The action resulting from the lack of conformity lapses two years after delivery of the goods.

10.2. Guarantee for hidden defects

Article 1641 of the Civil Code

The seller is bound by the guarantee for hidden defects in the thing sold which makes it unfit for the use for which it is intended, or which reduces such use so much that the buyer would not have acquired it, or would have given a lower price, if he had known them.

Article 1648 paragraph 1 of the Civil Code

The action resulting from latent defects must be brought by the purchaser within two years from the discovery of the defect.

10.3. Method of implementation of legal guarantees

For any request relating to the implementation of one of the legal guarantees referred to in  11.1. and 11.2. of these general conditions of sale, the Customer must contact customer service who will indicate the procedure to follow.

[email protected] undertakes, at the choice of the Customer, either to reimburse the price of the product, or to exchange the Customer's product for an identical product depending on the stocks available.

The refund or exchange of the product will be made within thirty days of the date of receipt of the request for implementation of the Legal Guarantee by the Customer, provided that the product has been returned to [email protected]

11. Personal data

11.1. [email protected] undertakes not to disclose to third parties the information communicated by Customers on the website. This information is confidential and will only be used by [email protected] for the processing of the Customer's order and the personalisation of communications, in particular by letters / emails.

11.2. This article cannot prevent the assignment or transfer of activities to a third party.

In accordance with the data protection act n ° 78–17 of January 6, 1978, the Customer can exercise his right of access to the file and his right of rectification or deletion for the information concerning him by addressing his request to: Saniflo, Unit 1 Watford Interchange, Colonial Way, Watford, Herts WD24 4WP

12. Entire contract

These general conditions of sale express all the obligations of the parties.

In the event that any of the terms of the general conditions of sale would be considered illegal or unenforceable by a court decision, the other provisions will remain in force.

The fact that [email protected] does not take advantage of any of these general conditions of sale at any given time cannot be interpreted as a waiver of the right to take advantage of any of these conditions at a later date.

13. Applicable law - litigation

13.1. These general conditions of sale are subject to European & UK law.

13.2. In the event of a dispute, the customer will first contact [email protected] to obtain an amicable solution.

Otherwise, the UK courts will have sole jurisdiction.
